Opposition Rights Under the Trademark Law of Myanmar

Under the Myanmar Trademark Law, if someone applies to register a mark that may affect your rights, you have the legal right to oppose that application.

How it works:

  1. Once a trademark application is published from the Intellectual Property Department of Myanmar, any interested person can file an opposition.
  2. The opposition must be submitted within 60 days from the date of publication.
  3. A prescribed fee must be paid, and the opposition must be based on the grounds mentioned in Section 13 and 14 of the Trademark Law. This process ensures that owners of existing trademarks, or those with prior rights, can prevent the registration of marks that are confusingly similar, misleading, or infringing.

Why this matters:

If you don’t take timely action, a conflicting mark could be registered and once registered, oppose to remove from registration its becomes much harder and costlier.
